EXCURSION CONDITIONS
Eco Nautisme Marseille (ENM) reserves the right to modify routes or cancel services in the event of bad weather conditions. Only the captain is authorized to judge sailing conditions, and may cancel a maritime service. In the event of cancellation by Eco Nautisme Marseille (ENM), passengers may be refunded, or the excursion may be postponed to another date with your agreement.
Swimming is permitted during stopovers, under your own responsibility. Under no circumstances may the loan of swimming equipment be considered a supervised water activity.
Passengers agree in all cases to comply with the on-board regulations established by Eco Nautisme Marseille (ENM), as well as to follow the orders of the captain and crew. Passengers must arrive 15 minutes before departure time. No refund may be claimed in the event of passenger lateness.
ALCOHOL ON BOARD
Excursions en billetterie :
Bringing and consuming alcoholic drinks from outside is prohibited on board, unless expressly authorised in advance by Eco Nautisme Marseille (ENM).
Any passenger arriving for boarding with alcohol from outside without prior authorisation may be refused access to the vessel, with no refund.
If a passenger brings alcohol on board despite this prohibition and their behaviour, in particular through intoxication, compromises the safety of the people on board or of the vessel, or the smooth running of the trip, the crew may take any necessary measure, up to and including disembarking the passenger, with no refund.
Where disembarkation takes place somewhere other than the original boarding point, or entails compensation costs for the other passengers, all costs directly arising from that situation may be charged to the passenger concerned.
Private charters:
For a private charter, passengers are allowed to bring their own drinks on board.
However, for safety reasons, alcohol consumption may be monitored, limited or stopped by the skipper or the crew if they consider that the behaviour of one or more passengers is liable to endanger the people on board, third parties or the vessel, or to compromise the smooth running of the service.
In the event of dangerous or inappropriate behaviour linked in particular to alcohol consumption, the skipper or the crew may take any necessary measure, up to and including disembarking the passenger or passengers concerned, with no refund.
Where disembarkation takes place somewhere other than the original boarding point, or requires the involvement of third parties, all costs directly arising from that situation may be charged to the passenger concerned.
CANCELLATION CONDITIONS FOR YOUR EXCURSION – PRIVATIZATION –
- By Eco Nautisme Marseille (ENM):
If, due to bad weather conditions, the outing cannot take place, and this solely at the discretion of the owner or captain, you will be fully refunded all sums advanced, and no fees will be withheld.
– By the customer:
If for personal reasons you choose to cancel your tour 1 month before the date of the tour, your deposit will be returned to you and no charges will be deducted.
Should you have to cancel your excursion between 15 days and 1 month before the date of the excursion, your deposit will not be refunded (up to 30% of the total cost of the excursion).
Should you have to cancel your excursion less than 15 days before the date of the excursion, all sums paid will be forfeited.
CANCELLATION CONDITIONS FOR YOUR EXCURSION – TICKETS –
- By Eco Nautisme Marseille (ENM):
– In the event of a proposed program change
It may happen that the weather does not allow us to follow the usual program, but does allow a beautiful sail in another direction. In this case, the captain and the Eco Nautisme Marseille (ENM) team may offer you a change of itinerary before departure.
– If the change of itinerary is accepted, the customer will take part in the full day and may not subsequently request any refund or reduction
– In the event of refusal, the customer will not take part in the day and will be fully refunded.
If, due to bad weather conditions, the outing cannot take place at all, you will be fully refunded all sums advanced, and no fees will be withheld.
– By the customer:
If for personal reasons you choose to cancel your tour 1 week before the date of the tour, you will receive a full refund.
If you have to cancel your excursion between 6 and 3 days before the date of the excursion, we will retain 50% of the amount paid.
Should you have to cancel your excursion less than 48 hours before the date of the excursion, all sums paid will be forfeited.
ELECTRONIC TICKET (for ticketed outings)
The electronic ticket is a paperless ticket. For all reservations, you must present yourself with your booking confirmation document, the "confirmation email", which serves as your electronic ticket.
TRANSPORT TICKET AND ACCEPTANCE OF CONTRACTUAL CONDITIONS:
Making an online reservation on the Eco Nautisme Marseille (ENM) website constitutes a contract entailing acceptance of these general terms of sale and transport by all participants in the nautical and aquatic activities offered by Eco Nautisme Marseille (ENM) on whose behalf the reservation was made.
The electronic ticket, which corresponds to the online (or email) confirmation of your reservation by Eco Nautisme Marseille (ENM), is personal and non-transferable. It must be kept by the customer who made the online reservation for one or more persons.
PASSENGER HEALTH:
Passengers must inform Eco Nautisme Marseille (ENM) of any contraindication or inability that would prevent them from taking part in the services it offers (nautical activities: sea excursions, water sports and aquatic activities, swimming, snorkeling, etc.).
Passengers embark under their own responsibility and may not hold Eco Nautisme Marseille (ENM) liable in the event of bodily injury related to their state of health (disability, illness, etc.), whether on board, during boarding or disembarking operations, or during nautical or aquatic activities.
Passengers who, due to their state of health, require special assistance during the excursion or the nautical and aquatic activities (persons with reduced mobility, visually impaired, etc.) are asked to inform the Eco Nautisme Marseille (ENM) crew when booking and when boarding.
PREGNANT WOMEN:
Pregnant women may take part in a sea excursion, under their own full responsibility.
However, they may not hold Eco Nautisme Marseille (ENM) liable for any reason whatsoever in the event of bodily injury.
Eco Nautisme Marseille (ENM) may not be held liable in the event of bodily injury, or any other incident, related to the pregnancy.
MINORS:
Eco Nautisme Marseille (ENM) does not transport unaccompanied minors. They will board and take part in excursions, as well as nautical and aquatic activities, under the exclusive responsibility of their accompanying adult(s).
Children under two years of age must wear a suitable life jacket. Parents must report their presence to Eco Nautisme Marseille (ENM) when booking or before boarding.
PASSENGER CONDUCT:
During the voyage, passengers must remain seated. During boarding and disembarking operations, as well as on board, they must comply with the ship's regulations, in particular those established by Eco Nautisme Marseille (ENM), and, in general, follow the recommendations and instructions of the captain and crew.
Eco Nautisme Marseille (ENM) declines all responsibility for any bodily injury suffered by passengers who fail to comply with these requirements, whether on board or during boarding or disembarking operations.
Passengers will be held responsible for any damage of any kind whatsoever that they may cause to themselves, to other passengers, to third parties, or to the persons and property of Eco Nautisme Marseille (ENM).
The same applies to all damage of any kind caused by persons or property under the passengers' care.
Eco Nautisme Marseille (ENM) allows swimming during excursions at the "swimming breaks" in the calanques. However, swimming is unsupervised and takes place under the passengers' own responsibility. On these occasions, minors remain under the responsibility of their accompanying adult(s). Anyone who cannot swim or swims poorly must inform the crew.
Eco Nautisme Marseille (ENM) provides passengers with buoys and flotation vests.
Eco Nautisme Marseille (ENM) declines all responsibility in the event of incidents or bodily injury occurring during swimming.
BODILY INJURY:
Any injury occurring during excursions or nautical and aquatic activities must be reported by the passenger to Eco Nautisme Marseille (ENM) before leaving the ship.
In the event of damage to their person and/or property (personal items, etc.), passengers must report it to the ship's crew. Eco Nautisme Marseille (ENM) will draw up a joint report in the presence of the passenger(s) concerned before they leave the ship. Failing this, passengers will be presumed to have disembarked safe and sound with their belongings in good condition.
Eco Nautisme Marseille (ENM) declines all responsibility, except in the cases provided for by articles L5421-2 et seq. of the French Transport Code, for bodily accidents occurring during sailing, during excursions or nautical and aquatic activities, or during boarding or disembarking operations, whether at the ports of departure or destination, at ports of call, or at sea while swimming.
PERSONAL ITEMS AND EQUIPMENT:
Passengers may bring their personal equipment on board (camera, mask, snorkel, fins) under their own responsibility.
Eco Nautisme Marseille (ENM) declines all responsibility for baggage, personal items or equipment brought on board by passengers, as well as for money, jewelry or other valuables, which remain the exclusive responsibility of their owners during excursions and any other activity offered by Eco Nautisme Marseille (ENM).
FREE LOAN OF EQUIPMENT:
Eco Nautisme Marseille (ENM) provides passengers, free of charge, with equipment for the nautical and aquatic activities it offers (fins, masks, snorkels, windbreakers, etc.).
Where applicable, defective equipment does not entitle passengers to any refund or reduction.
Eco Nautisme Marseille (ENM) reserves the right to take legal action against passengers who deliberately damage or degrade the equipment loaned free of charge.
ORGANIZATION OF EVENING EVENTS AND FESTIVE EXCURSIONS:
As part of the evening events and festive excursions organized by Eco Nautisme Marseille (ENM) (cocktails, evenings in the calanques, bachelorette or bachelor parties, etc.), moderate consumption of alcohol and tobacco is permitted.
For the safety and comfort of passengers, Eco Nautisme Marseille (ENM) staff may limit or prohibit the consumption of alcohol, tobacco or drugs.
Eco Nautisme Marseille (ENM) may take any measures or steps necessary with regard to passengers who, through their behavior:
Endanger a person or a member of staff, damage or degrade property belonging to Eco Nautisme Marseille (ENM), prevent staff from carrying out their duties, or fail to comply with the recommendations and instructions of staff members or the captain.
Eco Nautisme Marseille (ENM) reserves the right to disembark passengers whose behavior compromises the safety, tranquility or comfort of other passengers or staff members.
FINANCIAL TERMS
The descriptions of the Services presented on the Site specify, for each service, the services included in the price. Prices are shown in euros. Prices are quoted inclusive of all taxes (TTC) and/or exclusive of tax (HT) as applicable and as specified in the proposed quote; the related fees and service costs are either included or additional, as specified in the quote.
For our Tickets activity, our rates are quoted inclusive of tax, with a VAT rate of 10%.
For our Privatization activity:
– Cruises with our set routes are offered with a VAT rate of 10%.
– Tailor-made events are offered with a VAT rate of 20%.
Payments made on the Site are by credit card (Carte Bleue, Visa, Eurocard/Mastercard and American Express cards are accepted) via a secure payment system.
Should the payment prove to be irregular, incomplete or nonexistent, for a reason attributable to You, the sale of these services will be canceled, with the
resulting costs being borne by you; civil and/or criminal action may, where applicable, be taken against you.
INTELLECTUAL PROPERTY
Eco Nautisme Marseille (ENM) holds all intellectual property rights relating to the Site, which belong to it, or holds the related usage rights.
Access to the Site does not confer on you any right to the intellectual property rights relating to the Site, which remains the exclusive property of Eco Nautisme Marseille (ENM).
The elements accessible on the Site, in particular in the form of texts, photographs, images, icons, maps, sounds, videos, software, databases and data, are also protected by intellectual property rights.
Except as explicitly stated in this document, you may not, under any circumstances, reproduce, represent, modify, transmit, publish or adapt, on any medium whatsoever, by any means whatsoever, or exploit in any way whatsoever, all or part of the Site without the prior written authorization of Eco Nautisme Marseille (ENM).
LATENESS
We would like to remind you that, as a transport company, we make a point of respecting precise schedules to ensure a pleasant experience for all our passengers. That's why we leave at the scheduled time, and ask passengers to be at the landing stage 10 minutes before departure.
If you are running late, we would be grateful if you could :
1) Call us as soon as possible.
2) Indicate your estimated time of arrival.
We understand that unforeseen circumstances may arise, but please note that in the event of a delay of more than 10 minutes, we will unfortunately have to leave without you. In this case, no refund or postponement will be possible.
Please also note that we cannot be held responsible for any transport-related problems (traffic jams, subway/train delays, etc.).
